Supporting Evidence for I-485 Applicants
In order to renew a driver’s license in the US while an I-485 is pending, applicants should prepare a set of specific documents. These documents serve as proof of the ongoing adjustment of status application, work authorization, and the applicant’s identity and residency.
Evidence of Pending I-485
Applicants must provide documentation verifying their I-485 application is currently pending. A Notice of Action, Form I-797C, showing the receipt of the I-485 application is typically required. This should be accompanied by a copy of the submitted Form I-485 as additional proof.
Work Authorization and Advance Parole
Work Authorization: Renewing a driver’s license may necessitate evidence of work authorization. This can be satisfied with a valid Employment Authorization Document (EAD), indicated by Form I-766.
Advance Parole: If the applicant has applied for Advance Parole, a document such as Form I-512L can support their case, indicating permission to travel and re-enter the US while the I-485 is pending.
Proof of Identity and Residency
Driver’s license renewal also requires proof of identity and residency. The following items are conventionally needed:
- Proof of Identity: A passport, birth certificate, or other government-issued identification.
- Proof of Residency: Evidence may include recent utility bills, lease agreements, or bank statements with the applicant’s name and current address.
