What Are the Eligibility Criteria for the EB1 Visa?

Standard Eligibility Requirements

To be eligible to receive an EB-1 Visa, you must be one of these:

  • A multinational executive/manager
  • An outstanding professor or researcher
  • An alien of extraordinary ability in a professional or major trade

Eligibility Requirements – Alien of Extraordinary Ability (Leading or Critical Role, Internationally Recognized Prizes, and Being Published in Major Trade Publications, Among Others) (EB-1A)

Foreign nationals who wish to apply for the EB-1A Visa must show extraordinary ability. This means they can demonstrate that they’re in the top one percent in their field and receive national or international acclaim.

To prove that you meet those requirements, you must show evidence of an outstanding achievement. One option is to include proof that you’ve earned any major internationally recognized award, such as an Academy Award, Nobel Prize, or Olympic Medal.

Likewise, you must meet three (or more) of the 10 criteria set up by the United States Citizenship and Immigration Services (USCIS) (or other comparable evidence).

These include:

  • Evidence showcasing commercial success in the performing arts, such as sales records or box office receipts.
  • Evidence of a high salary or any other significantly high remuneration similar to what others in the field have.
  • Evidence of work being displayed in artistic showcases or exhibitions without other significantly high remuneration proof.
  • Evidence of performance within a leading or critical role through various distinguished organizations.
  • Evidence that you’ve authored scholarly articles in professional or major trade publications or other media.
  • There should be evidence of any original scientific, artistic, scholarly, athletic, and business-related contributions. Business-related contributions should be of major significance in your field.
  • Evidence of being asked to judge other’s work, such as on a panel or individually.
  • Evidence of any published material about you personally in the many professional or major trade publications or any other major media.
  • Evidence of your outstanding achievement within distinguished organizations.
  • Evidence of membership in associations relating to your field demanding outstanding achievement (no published material in other major media required).
  • Evidence of receiving lesser internationally recognized prizes/awards is of major significance to the world.

Eligibility Requirements – Researchers and Professors (EB-1B)

Any outstanding professors and researchers must have three years of experience in their particular academic field (teaching or research) and should demonstrate outstanding achievement or international recognition.

They must meet two of the six criteria from the USCIS (or have other comparable evidence) and provide job offer proof from a US-based employer.

The requirements are listed below:

  • Evidence of authoring scholarly articles or books in your field.
  • Evidence of scholarly research contributions or original scientific contributions in your field.
  • Evidence of participating as a judge for the work of others in the same/related field.
  • Evidence of published material within professional or major trade publications that others have written about your work.
  • Proof that you’re a member of an association requiring you to demonstrate an outstanding achievement (such as publishing scholarly articles in other major media).
  • Evidence of receipts for significant awards or prizes showcasing outstanding achievement.

Eligibility Requirements – Multinational Managers (EB-1C)

A multinational manager or executive can be considered for the EB-1C Visa. However, they must have been employed outside the US for at least one year within the past three years preceding the petition for the visa. If they’re already working within the United States through a non-immigrant visa, they must have worked abroad for at least one year before coming to the US.

The employer who petitions for the visa must have been in business for one year prior and have a qualifying relationship with where you worked abroad, such as through a subsidiary or affiliate of the same company. Likewise, the employer must intend for you to be in an executive or managerial role.

For this visa petition, you won’t need a labor certification and don’t have to provide evidence of scholarly research contributions. However, the employer must offer you a job. This visa doesn’t require you to make a significant investment like others.

The Application Process for the EB1 Visa

Applying for an EB-1 Visa involves multiple steps, which involve you (the foreign employee) and the employer.

The application process requires these parts:

  • The US-based employer must obtain a labor certification and file appropriate petitions.
  • If approved, you (the foreign employee) must apply for the EB-1 Visa through the US Embassy in your home country.

If you’re applying because you have extraordinary abilities, you don’t require your employer to file a petition and can do this step yourself. However, for multinational managers and professors/researchers, the employer must file the petition on your behalf.

EB1 Visa Application Through a US Employer

Here are the application process steps when filing through a US-based employer:

Labor Certification

Before a US-based employer can hire a foreign employee, they must contact the United States Department of Labor and get a labor certification. To do that, they’ll file Form ETA-750.

By submitting Form ETA-750, the employer states that they’ve tried finding a US employee for the job position and couldn’t. Therefore, the foreign worker will be paid for the work.

The DOL will process the form and notify you and the employer of its decision. If approved, the employer will move to the next step. If denied, you cannot get an EB-1 Visa.

Filing the Petition

Apart from the labor certification, the employer must file a petition with the USCIS through Form I-140. They must also attach tax returns, audits, and other financial statements proving a financially stable company. The applicant may also petition the USCIS for an Extraordinary Ability Visa.

Generally, the USCIS processes the petition and notifies the employer. If approved, the case then goes to the NVC (National Visa Center). The NVC assigns you an invoice ID and case number. Likewise, it will send the application instructions to your foreign employee in your home country.

EB1 Visa Application from a Foreign Worker

If you (the foreign worker) are applying for an EB1 Visa, you’ll follow these steps:

File Form DS-260

The first step is to file Form DS-260, the application for an EB-1 Visa. Generally, the US Embassy will process it for you.

Complete the Medical Exam and Receive Appropriate Vaccinations

You’ll receive an NVC package with requirements about vaccinations and medical exams you must complete. Visiting a licensed doctor and having them sign and complete the documents is essential.

Gather Supporting Documents

Once Form DS-260 is approved, you’ll send supporting documents for your case.

These include:

  • Your passport (must be valid for six months or more after you intend to come to the US)
  • The approved labor certification
  • The employment offer from your US-based employer
  • The DS-260 confirmation page
  • Your approved petition
  • Court/criminal records
  • Letters from your previous employers
  • A sponsorship letter from your US-based employer
  • Proof you’ve met the criteria
  • Two photographs
  • Signed vaccine and medical documents

Attend an EB1 Visa Interview

The NVC reviews your documents and application and schedules an interview with the US Embassy in your country. You’ll attend and answer questions, waiting for the interviewer to decide.

Receive Your NVC Package and Come to the US

If you’re approved for the EB-1 Visa, you’ll receive a welcome package from the NVC. Do not open it, but take it whenever you travel to the United States, presenting it to the immigration officer.

EB1 Visa Fees

When applying for an EB-1 Visa, you’ll be responsible for paying various fees. The amounts will vary because they’re decided on by the US Embassy in your country and the USCIS.

Generally, these are the fees you’re required to pay:

  • Filing fee for the USCIS Form I-140
  • Fees to receive your supporting documents (printing, mailing, etc.)
  • Fees for medical examinations and vaccinations
  • Processing fee for Form DS-260
  • Translation fees from your foreign language into English

How Long Will It Take Before You Receive the EB1 Visa?

The application process for the EB-1 Visa depends on which category you’re in.

If you’re applying because you have an extraordinary ability, you can self-petition. Therefore, you’ll complete Form I-140 and apply to the USCIS personally.

However, if you’re an outstanding professor or researcher or apply as a multinational manager or executive, your employer must file Form I-140 for you.

The US-based employer must show that it can continuously pay the offered wage. Proof can include a federal income tax return, an annual report, or an audited financial statement.

Though the process can seem lengthy, the EB1 Visa can often be acquired more quickly than other US Green Cards because US employers aren’t required to have a PERM Labor Certification for you.
